For example, if you are running a trade promotion and the value of the prizes exceeds A$5,000 then you need to register that promotion with Consumer Affairs in Victoria- but not with CA in Tasmania. There is a difference between games of skill and games of chance – and the terms and conditions of running these games vary depending on what sort of competition you are running. This is one of the most frustrating and jumbled areas of law which falls under the I.P. umbrella – every promotion, competition or game needs to be assessed individually – first to find out which laws apply and THEN to find out how to comply with them.
